Terms of Service

These Terms of Service ("Terms") set out the conditions for use of the AI image generation Chrome extension and web application (mimicit.app) provided by Mimicit ("Service").

By using the Service, you agree to these Terms. Your continued use of the Service constitutes your acceptance of these Terms.

These Terms are written in legal language but we have tried to keep it as plain as possible. If you do not agree to these Terms, please discontinue use of the Service.

To use the Service, you must complete registration by creating an account using the prescribed method (Google OAuth).

Please provide accurate and truthful information during registration. If your information changes, please update it promptly.

Each user may hold only one account. Creating or using multiple accounts (e.g., to obtain unauthorized free credits) is prohibited. Confirmed violations may result in suspension of all related accounts.

Users under 18 must obtain parental consent before using the Service. We do not accept users under 13.

Users must keep their account credentials (linked Google account, session cookies, etc.) strictly confidential and must not disclose, lend, or transfer them to third parties.

All actions taken through an account will be deemed actions of that account's user.

If you discover unauthorized use of your account, please contact us immediately. We will verify the situation and take appropriate measures such as forced session termination if necessary.

We bear no responsibility for damages resulting from unauthorized account use, except in cases of our intentional misconduct or gross negligence.

Users must not engage in any of the following. Confirmed violations may result in warnings, content removal, account suspension, or claims for damages.

(1) Acts that violate laws or public order and morals (2) Criminal acts or acts related to crime (3) Generating or distributing inappropriate content including child pornography, sexual abuse imagery, violence, or discrimination (4) Acts that infringe on third parties' copyrights, trademarks, portrait rights, privacy rights, publicity rights, or other rights (5) Acts that harm other users or third parties, harassment, or impersonation (6) Unauthorized access to our servers or acts placing excessive load on them (DDoS, excessive requests, etc.) (7) Reverse engineering, decompiling, modifying the Service, or creating derivative services (8) Unauthorized resale or redistribution for commercial purposes (including resale of credits) (9) Mass access using scraping or automated tools, bot usage (10) Registering false information, creating or operating multiple accounts (11) Using images generated by the Service to impersonate others without their consent (e.g., deepfakes) (12) Any other acts we deem inappropriate

Copyrights for programs, text, logos, designs, and other content provided by the Service belong to us or legitimate rights holders.

Rights to images generated by users are subject to the policies of the AI model provider used and applicable laws. Be sure to check each model's terms. Mimicit acts as an API consumer and does not claim independent rights over generated images.

Users are responsible for only using source images for which they hold copyright, usage rights, portrait rights, or other legitimate rights. When using free assets, please verify each license's conditions (credit attribution, commercial use, etc.).

We bear no responsibility for disputes or damages arising from unauthorized use of third-party works as source images.

Upon receiving a credible rights infringement notice, we will review the matter within a reasonable period and take action such as removing the content or suspending the related account if necessary.

Some features of the Service are provided on a credit basis. Credits can be purchased within the Service via the prescribed method (card payment via Stripe). This is not a subscription, so there are no recurring charges or cancellation procedures.

Prices and credit amounts may change without prior notice. However, already-purchased credits are consumed at their original purchase rate.

Purchased credits are generally non-refundable. However, this does not apply if the Service is significantly unavailable due to a critical defect on our part.

Free credits (sign-up bonuses, promotional credits, etc.) may have an expiry date.

Remaining credits will not be refunded upon account deletion.

Credits cannot be exchanged for cash, transferred, or sold outside the Service.

We may change, suspend, or terminate all or part of the Service without prior notice in the following cases:

(1) When performing scheduled or emergency maintenance (2) When force majeure events occur such as system failures, natural disasters, disease outbreaks, war, or terrorism (3) When third-party services (AI model APIs, payment services, hosting, etc.) are suspended or change their specifications (4) When laws or guidelines change (5) When there are other unavoidable operational circumstances

We bear no responsibility for damages to users arising from changes, suspension, or termination of the Service, except in cases of our intentional misconduct or gross negligence.

If we fully terminate the Service, we will, in principle, give at least 90 days advance notice and provide a window for users to export their generated data.

The Service is provided "as is." We make no warranties, express or implied, regarding the continuity, quality, fitness for a particular purpose, accuracy, or non-infringement of third-party rights.

We make no warranties regarding the content, quality, or legality of content generated through the Service. AI models can occasionally produce incorrect or inappropriate content. Decisions to use generated output are at your own risk.

We bear no responsibility for any direct or indirect damages (including lost profits and data loss) arising from use or inability to use the Service, except in cases of our intentional misconduct or gross negligence.

Even where our liability is recognized, it shall be limited to the amount paid by the user to us in the past 6 months.

The above limitations do not apply to the extent prohibited by mandatory consumer protection law or other binding regulations.

Personal information will be handled in accordance with our separate Privacy Policy.

The Privacy Policy is treated as integral to these Terms; agreement to use the Service includes agreement to the Privacy Policy.

We may suspend or delete accounts without prior notice if a user violates these Terms or if we otherwise deem it inappropriate.

Serious violations (child sexual abuse material, clear rights infringement, impersonation, etc.) result in immediate suspension or deletion. For minor violations, we may issue a warning first.

We bear no responsibility for loss of data or credits resulting from account deletion.

If you wish to delete your own account, please do so from the Profile page in the Dashboard. Within 30 days of deletion, all data will be removed except for data legally required to be retained.

We may change these Terms as we deem necessary.

We will notify you of important changes via an in-app banner or email in advance (minor typo corrections are excluded). Changed Terms take effect when posted on the website.

If you do not agree to the changes, you may end your use of the Service by deleting your account before the changes take effect. Continued use of the Service after changes constitutes acceptance of the revised Terms.

If any provision of these Terms is found invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.

Any invalid or unenforceable provision shall be interpreted as replaced by the lawful provision closest to the original intent.

These Terms shall be governed by and construed in accordance with the laws of Japan.

In the event of any dispute arising in connection with these Terms, the Tokyo Summary Court or the Tokyo District Court (depending on the amount in controversy) shall be the court of exclusive jurisdiction for the first instance.
